1. Who we are

Lovender (the "Service", at lovender.ai and any related apps) is operated by LOVEA TECH LIMITED, a private limited company registered in England and Wales under company number 17473866, with its registered office at 128 City Road, London, EC1V 2NX, United Kingdom ("we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy, Cookie Policy, Refund Policy, Community Guidelines and Content Moderation Policy, which form part of these Terms. If you do not agree, do not use the Service.

2. What Lovender is

Lovender is an adult entertainment service where you can chat and role-play with AI companions, create your own fictional characters and generate images of those fictional AI characters.

• You are talking to an AI, not a person. All characters are fictional and all replies and images are generated automatically by artificial intelligence. Any resemblance to real people is coincidental. AI can be wrong, inconsistent or inappropriate, so don't rely on it for decisions.
• Lovender is not a source of medical, psychological, legal or financial advice and is not a substitute for professional help or real relationships. If you are in crisis or in danger, contact local emergency services. See our Safety Center.

3. Age and eligibility

• You must be at least 18 years old (or the age of majority where you live, if higher) to use the Service.
• We use age assurance checks, which may be carried out by a trusted third-party provider. We may ask you to verify your age at any time and may restrict access until you do.
• You must not use the Service where adult content is illegal for you to access.
• If we believe a user is under 18, we will close the account immediately.

4. Your account

• Give accurate information and keep your login details private. You are responsible for activity on your account.
• One account per person. Accounts are personal and cannot be sold or transferred.
• Tell us straight away at [email protected] if you think your account has been accessed without permission.
• If you sign in with Google, Apple or another provider, that provider's terms and privacy policy also apply.

5. Free access, credits and payments

• Free access. Some features are free with daily or usage limits. We can change free limits at any time.
• Credits. Paid features (for example extra messages, image generation or premium characters) use credits, which you buy in packs. Prices and the credit cost of each feature are shown before you pay.
• Credits are a licence to use features of the Service. They have no cash value, cannot be exchanged for money, and cannot be transferred or sold.
• Credits do not expire while your account is active. If we close your account because of a serious or repeated breach of these Terms (for example, content involving minors or real people), unused credits are lost. In other cases, see the Refund Policy. If you close your account yourself, see the Refund Policy for unused credits.
• Payments are handled by our third-party payment providers. We do not store your full card details. Prices include VAT where applicable.
• We may change prices for future purchases. This does not affect credits you have already bought.
• Refunds and your right to cancel are explained in our Refund Policy.

6. Rules you must follow

You must follow our Community Guidelines. In particular, you must not:

• create, request or share any content that sexualises minors or characters that are, or appear to be, under 18. This includes "age play", school settings with sexual content and child-like descriptions. We report this to the authorities.
• upload photos of real people or ask the Service to create sexual, nude or intimate content that depicts, imitates or resembles a real person (including celebrities, people you know and yourself), or create any "deepfake" of a real person.
• create content involving non-consensual sexual acts presented approvingly, sexual violence, bestiality, incest, or extreme or illegal material.
• use the Service to harass, threaten, defraud or impersonate anyone, promote terrorism or violence, or break any law.
• try to bypass our safety filters, age checks or limits, scrape or reverse-engineer the Service, use bots, or resell access.
• use the Service for commercial purposes without our written permission.

7. Your content and AI-generated content

• Your inputs (messages, prompts and character descriptions) remain yours. You give us a worldwide, non-exclusive, royalty-free licence to host, process and use them to run, secure and improve the Service.
• Outputs (AI replies and images) are generated for your personal, non-commercial use. As far as the law allows, we grant you the right to use your outputs privately. You must not use outputs to mislead people into thinking they show a real person.
• We may use de-identified conversation data to improve our models and safety systems, as described in the Privacy Policy.
• We do not review all content in real time, but we use automated filters and human review and may block, remove or refuse any content. See Content Moderation.

8. Our intellectual property

The Service, including its software, design, characters we create, logos and the Lovender name, belongs to us or our licensors. You may not copy or use them except as these Terms allow. If you believe something on the Service infringes your copyright, email [email protected] with details of the work, where it appears, your contact details, and a statement that your complaint is accurate and made in good faith.

9. Suspension and closing your account

• You can delete your account at any time in your account settings or by emailing [email protected]. Deletion is permanent.
• We may suspend or close your account, without notice where necessary, if you break these Terms, if the law requires it, or to protect users or the Service. Where reasonable we will tell you why. You can appeal as explained in Content Moderation.
• We may change, pause or stop parts of the Service. If we stop the Service entirely, we will give reasonable notice and refund unused paid credits.

10. Our responsibility to you

• The Service is provided "as is" and "as available". We try to keep it working and safe but cannot promise it will always be available, error-free or that AI outputs will be accurate or suitable.
• We are not responsible for losses that were not foreseeable, for business losses, or for losses caused by your breach of these Terms or by events outside our control.
• Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim.
• Nothing in these Terms limits liability that cannot be limited by law, including death or personal injury caused by negligence, fraud, or your statutory rights as a consumer (for example under the UK Consumer Rights Act 2015).

11. If you misuse the Service

If you use the Service in breach of these Terms or the law, you are responsible for the consequences of your actions. We may take the steps described in section 9 and in our Content Moderation Policy.

12. Changes to these Terms

We may update these Terms from time to time. We will show the new date at the top and, for important changes, tell you by email or in the app before they take effect. If you keep using the Service after changes take effect, you accept the new Terms.

13. Complaints, governing law and disputes

• Please contact [email protected] first. We aim to reply within 5 business days.
• These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland, Northern Ireland, the EU or elsewhere, you keep any mandatory consumer protections and the right to bring claims in your local courts.
• If any part of these Terms is found invalid, the rest remains in force. If we don't enforce a right straight away, we can still enforce it later.
